## 1. Agreement to These Terms These Terms and Conditions ("Terms") govern your access to and use of regentwash.com and related pages (the "Site") and any quotes, communications, and services provided by Regent Wash LLC ("Regent Wash," "we," "us," or "our"). By using the Site, requesting a quote, or engaging our services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or our services. ## 2. Our Services Regent Wash provides residential exterior cleaning services, including pressure washing, soft washing, house washing, and related surface cleaning, primarily in Delaware County, Pennsylvania and surrounding areas. Descriptions on the Site are general information only. The specific scope, price, and schedule of any job are set out in the quote or work agreement we provide to you, which controls if there is any conflict with the Site. ## 3. Quotes, Estimates, and Pricing - Quotes are free and are based on the information you provide and, where applicable, an on-site assessment. - Estimates are valid for 30 days unless we state otherwise, and they may change if actual conditions differ from what was described, such as the size, surface type, condition, or accessibility of the areas to be cleaned. - Prices do not include applicable taxes unless stated. Payment is due upon completion of the work unless we agree otherwise in writing. - Late or unpaid balances may be subject to reasonable collection costs to the extent permitted by law. ## 4. Scheduling, Access, Weather, and Cancellations - You agree to provide safe and clear access to the areas to be cleaned, along with a working outdoor water source and electrical outlet if needed. - Because exterior cleaning depends on safe conditions, we may reschedule due to weather, temperature, or safety concerns. We will make reasonable efforts to give you notice. - If you need to cancel or reschedule, please give us as much notice as possible. We reserve the right to charge a reasonable fee for cancellations made without adequate notice or for trips where we cannot access the property as arranged. ## 5. Your Responsibilities and Property Condition - You represent that you own the property or are authorized to request the Services for it. - Before we begin, you agree to close and secure windows and doors, remove or secure vehicles, furniture, decorations, and fragile items, and keep children and pets safely away from work areas. - You agree to tell us in advance about any pre-existing damage or conditions, such as loose or damaged siding, failing paint or sealant, oxidation, cracked or open windows, leaks, faulty seals, damaged screens, or delicate landscaping. - Exterior cleaning can expose or reveal pre-existing wear or damage. We are not responsible for pre-existing conditions or for damage that results from conditions that were not disclosed to us or that are not reasonably visible before work begins. ## 6. Results Disclaimer We take pride in delivering excellent results. However, exterior cleaning improves appearance and cannot guarantee the complete removal of every stain, and some materials may be permanently affected before we arrive. Conditions such as deep oxidation, rust, artillery fungus, mineral deposits, paint failure, staining, or discoloration may not fully respond to cleaning, and some surfaces may already be worn or damaged in ways that become more visible once dirt is removed. ## 7. Satisfaction and Limited Warranty We stand behind our work. If you are not satisfied with a service, notify us within 7 days of completion and we will make reasonable efforts to address the concern. Your exclusive remedy under this limited warranty is for us to re-perform the affected portion of the service. Except as expressly stated here, we make no other warranties of any kind regarding the Services. ## 8. Disclaimer of Warranties The Site and the Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Regent Wash disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. ## 9. Limitation of Liability To the fullest extent permitted by law, Regent Wash and its owners, members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, or data, arising out of or relating to the Site or the Services. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the amount you actually paid to Regent Wash for the specific service that gave rise to the claim. ## 10. Indemnification You agree to indemnify, defend, and hold harmless Regent Wash and its owners, members, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of or related to your breach of these Terms, your misrepresentation of property ownership or condition, your violation of any law, or your misuse of the Site or the Services. ## 11. Intellectual Property The Site and its content, including text, graphics, logos, the Regent Wash name and crest, and images, are owned by Regent Wash LLC or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission. ## 12. Reviews, Testimonials, and Submitted Content If you submit a review, testimonial, photo, or other content to us or about us, you grant Regent Wash a non-exclusive, royalty-free, worldwide license to use, display, and share it in our marketing and on our Site and social media. You represent that your content is truthful, is yours to share, and does not violate the rights of others. ## 13. Communications Consent By providing your phone number and consent, you agree to receive calls and text messages from Regent Wash as described in our Privacy Policy, including through automated technology. Message and data rates may apply, and you can reply STOP to opt out of text messages at any time. ## 14. Third-Party Links The Site may contain links to third-party websites and platforms that we do not control. We are not responsible for the content, policies, or practices of any third-party site, and providing a link does not imply our endorsement. ## 15. Dispute Resolution, Binding Arbitration, and Class Action Waiver PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL. - Informal resolution first: Before starting arbitration, you agree to contact us at [email protected] and give us a chance to resolve the dispute informally. - Binding arbitration: Except as noted below, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in or near Delaware County, Pennsylvania. Judgment on the award may be entered in any court with jurisdiction. - Exceptions: Either party may bring an individual claim in small claims court, and either party may seek injunctive relief to protect intellectual property or confidential information. - Class action waiver: You and Regent Wash agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. - Jury trial waiver: To the extent a dispute proceeds in court rather than arbitration, you and Regent Wash each waive any right to a jury trial. - 30-day opt-out: You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. If you opt out, the "Governing Law and Venue" section will apply to disputes. ## 16. Governing Law and Venue These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. For any matter not subject to arbitration, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Delaware County, Pennsylvania. ## 17. Changes to These Terms We may update these Terms from time to time. When we do, we will revise the "Effective date" above and post the updated Terms on this page. Your continued use of the Site or the Services after changes take effect means you accept the updated Terms. ## 18. Severability, Entire Agreement, and Waiver If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with any written quote or work agreement and our Privacy Policy, make up the entire agreement between you and Regent Wash regarding the Site and the Services. Our failure to enforce any provision is not a waiver of our right to do so later. ## 19.
